Top earners will not be able to take their dismissal cases to CCMA

Imraan Mahomed, director at Routledge Modise, says that, if proposed labour law amendments are adopted, dismissal disputes involving employees at the upper end of the salary scale will be dealt with differently. Workers earning above a threshold of R1.3m a year will be excluded from protection against unfair dismissal in cases of misconduct, retrenchment or poor performance. That means no more need for inquiries or counselling – only a minimum of three months’ pay.
