NATIONAL CONGRESS: THE SUPREME GOVERNING BODY OF HOSPERSA

The National Congress stands as the supreme governing authority of Hospersa, convening every five years under the leadership of the President. This pivotal event brings together delegates from various Hospersa branches, following a formula established by the National Executive Committee (NEC). Prior to the National Congress, provincial congresses are held, mirroring the National Congress’s functions on a provincial level.

The primary responsibilities of the National Congress are as follows:

  • Election of National Office Bearers (NOBs): The National Congress elects the President, National Treasurer, and Vice-Presidents who will guide the Union.
  • Nomination and Confirmation of the National Executive Committee (NEC): Delegates nominate and confirm the members of the NEC, ensuring robust and representative leadership.
  • Policy Formulation and Report Consideration: Delegates review reports from the NEC, formulate Union policy, and make decisions based on these reports to guide future actions.
  • Constitutional Amendments: The Congress deliberates on and amends the Union’s Constitution to reflect evolving needs and goals.
  • Financial Oversight: Delegates examine financial reports, auditors’ reports, and approve the Union’s financial statements, ensuring fiscal responsibility.
  • Addressing Union Interests: The Congress addresses any matters that pertain to the interests of the Union, ensuring the welfare and representation of its members.

National Office Bearers (NOBs)

NATIONAL OFFICE BEARERS (NOBS): STEWARDS OF DAILY UNION OPERATIONS

The National Office Bearers (NOBs) are entrusted with the day-to-day management of Hospersa, ensuring the seamless operation of the Union. Meeting on a monthly basis, this esteemed group includes the General Secretary, who participates as a non-voting member of the committee.

The primary responsibilities of the NOBs are as follows:

  • Implementation of Financial and Administrative Plans: NOBs oversee the execution of strategic financial and administrative plans, ensuring the Union’s operations run smoothly and efficiently.
  • Execution of NEC Resolutions: They ensure that the resolutions passed by the National Executive Committee (NEC) are implemented effectively, maintaining alignment with the Union’s goals and objectives.
  • Final Appeal Structure on Disciplinary Matters: NOBs serve as the ultimate authority for appeals in disciplinary matters, ensuring fair and just resolutions.
  • Advisory Role to the NEC: They provide informed recommendations to the NEC, drawing from their daily management experience to guide the Union’s strategic direction.

Mr. Waheed Hoosen is a prominent figure in the South African labour movement, currently serving as the General Secretary of Hospersa (Health and Other Service Personnel Trade Union of South Africa). In addition to his role at Hospersa, he is also the Vice-President: Development at FEDUSA (Federation of Unions of South Africa). With extensive experience in labour relations and a commitment to advancing workers’ rights, Mr. Hoosen has been a key advocate for fair employment practices and social justice. His leadership and dedication have significantly contributed to shaping labour policies and improving conditions for workers across various sectors.

National Executive Committee (NEC)

GUIDING GOVERNANCE, ENSURING EXCELLENCE: THE NEC IN ACTION

The National Executive Committee (NEC) stands as the guiding force managing the union’s affairs between each National Congress, convening biannually. Comprising the National Office Bearers (NOBs), nine Provincial Chairpersons representing the provinces, one Committee member per 5,000 members (or part thereof) per province, and the General Secretary (serving ex officio), the NEC ensures the seamless operation and governance of the union.

Members of the NEC are elected for a term of five years, during which they may continue to serve unless required to vacate their position or are validly removed in accordance with the Hospersa Constitution. These members are also eligible for re-election upon the completion of their term.

In accordance with Hospersa’s Constitution, the NEC holds the following powers:

  • Employment Authority: Engage and dismiss any employee of the Union, delegating this function to the General Secretary in consultation with the NOBs.
  • Remuneration and Employment Terms: Approve the remuneration and terms of employment for Union employees.
  • Sub-Committee Appointments: Form sub-committees to investigate and report on matters referred by the National Congress or any other Union-related issues.
  • Policy Oversight: Review and amend decisions of the Provincial Congress concerning national policies.
  • Legal Proceedings: Institute or defend legal proceedings involving the Union.
  • Provincial Executive Suspension: Suspend any Provincial Executive Committee, assuming its powers until a new committee is constitutionally elected.
  • Financial Management: Approve or reject annual accounts and balance sheets, receive reports from the National Finance Committee, and consider budgets and payment of accounts.
  • Committee Reporting: Receive reports from and issue directives to the National Working Committee.
  • Appeals Management: Refer appeals related to membership admission, benefits, and discipline to the Appeals Committee.
  • Public Relations: Issue press statements on behalf of the Union.
  • Disciplinary Action: Take disciplinary action against Union officials.

In essence, the NEC is entrusted with the comprehensive oversight and strategic direction of the Union, ensuring adherence to its constitutional mandates and upholding the principles of fair and effective governance across all sectors.

National Working Committee (NWC)

The National Working Committee (NWC) comprises the National Office Bearers (NOBs), Provincial Chairpersons, and the General Secretary, all of whom serve on the National Executive Committee (NEC). This essential committee convenes at least once between each NEC meeting. The NWC is tasked with receiving detailed reports on the operational requirements of the Union, assessing these needs, and making strategic recommendations aimed at enhancing operational efficiency. Their dedicated efforts ensure the Union’s seamless functionality and responsiveness to its members’ needs.

National Finance Committee (FINCOM)

The National Finance Committee (FINCOM) is composed of the National Treasurer, the General Secretary, and the Provincial Treasurers, convening three times annually to ensure the Union’s financial integrity and transparency.

FINCOM’S RESPONSIBILITIES INCLUDE:
  • Preparing comprehensive financial reports for the National Executive Committee (NEC).
  • Scrutinizing the Union’s accounts and addressing any unusual expenditures.
  • Reviewing budgets and financial statements prepared by the National Treasurer and General Secretary prior to submission for NEC approval.
  • Conducting necessary inspections of financial records and transactions.
  • Recommending amendments to the Union’s financial policies.
  • Evaluating financial requests submitted by any province.
  • Proposing strategies to achieve the Union’s financial self-sufficiency.
  • Reporting all income and expenditures to the NEC and addressing any unbudgeted expenses.

Through these rigorous processes, FINCOM upholds the Union’s commitment to financial prudence and accountability, ensuring that resources are managed efficiently and transparently for the benefit of all members.

Provincial Executive Committee (PEC)

The Provincial Executive Committee (PEC) in each province of the Union is comprised of elected representatives, convening four times annually to address regional concerns and facilitate communication between members.

PEC membership includes:

  • Provincial Office Bearers.
  • One representative from each Local Shop Steward Council for every 1,000 members or part thereof.
  • Chairperson and Vice-Chairperson of the Local Shop Steward Council.
  • Duly elected provincial National Forum Representatives.

Through regular meetings and collaboration, the PEC ensures that provincial issues are addressed effectively, promoting unity and solidarity among members across different regions.

Local Shop Steward Council

Local Shop Steward Councils are integral bodies within the Union, fostering collaboration and support at the grassroots level. Comprising representatives from Branch Committees, these councils ensure effective communication and coordination of activities within their jurisdiction.

KEY FEATURES OF LOCAL SHOP STEWARD COUNCILS INCLUDE:
  • Membership composed of the Chairperson and Secretary from each Branch Committee with 500 or fewer members, and the Vice-Chairperson for branches exceeding 500 members, within the council’s jurisdiction.
  • Consisting of no fewer than three branches, collectively representing at least 1,000 members.
  • Geographical boundaries determined by the Provincial Executive Committee (PEC) and ratified by the National Executive Committee (NEC).
  • Quarterly meetings to review local activities, discuss branch decisions, and provide social assistance to members as needed.
  • Submission of comprehensive reports to the PEC regarding all local and branch activities within their jurisdiction.

Through these councils, members receive vital support and guidance while actively contributing to the fulfillment of the Union’s objectives and policies.

Branch Shop Steward Committee

BRANCH SHOP STEWARD COMMITTEE: NURTURING UNITY AND REPRESENTATION

Branches form the backbone of our union, and they are represented by dedicated Shop Steward Branch Committees. Comprising elected shop stewards, these committees govern union affairs within each establishment.

Branches thrive in workplaces with 25 or more members. In cases where there are fewer than 25 members but a minimum of 10, the Provincial Executive Committee may allow such establishments to operate under the guidance of existing branches. General Branch meetings and Shop Steward Branch Committee meetings are convened monthly to ensure active engagement.

The functions of the Branch Shop Steward Committee are multifaceted:

  • Foster positive relations between members and management within their establishment.
  • Uphold order, harmony, and discipline among members.
  • Utilize conciliatory methods to resolve disputes within the establishment.
  • Negotiate and finalize collective agreements sanctioned by the NEC or the PEC.
  • Attend all Branch Shop Steward committee meetings and report regularly on member concerns.
  • Ensure compliance with industrial agreements, wage determinations, and labor laws.
  • Serve as a vital link between establishment members and the broader union.
  • Communicate union decisions and address member grievances with management.
  • Facilitate the recruitment and enrollment of new union members.
  • Elect representatives to Provincial Congress as per the Hospersa Constitution.

Through diligent representation and proactive engagement, the Branch Shop Steward Committee champions the interests and rights of members across diverse workplaces.
